Your Trust-Based Estate Plan

Revocable Living Trust. The centrepiece of your plan. Your trust holds your assets during your lifetime and distributes them to your beneficiaries without probate when you pass away. You keep full control as trustee and can modify the trust at any time.

Pour-Over Will. A safety net that catches any assets not already in your trust and directs them there after you pass away. It also names guardians for minor children.

Powers of Attorney and Advance Directive. Financial power of attorney, medical power of attorney, and a living will or advance directive, the same incapacity planning documents included in the will package. These ensure someone you trust can act on your behalf.

Quitclaim Deed and Ancillary Documents. Transfer of one property into your trust via quitclaim deed, plus all necessary ancillary documents to fully fund and support your trust-based plan.

Washington has a state estate tax. If your total estate value is above approximately $3 million, it may be worth discussing disclaimer trust or credit shelter trust structures. The right approach depends on your specific circumstances, and we will cover this during your consultation if it applies to you. Learn more about Washington estate tax.

A pour-over will works alongside your trust. If any assets are not transferred into your trust during your lifetime, the pour-over will directs them into the trust after you pass away. It is a safety net to make sure everything ends up where you intended.
